Maybe it is time for minor lesson in American civics:
The Ninth Ciruit Court of Appeals is not the United States Supreme Court.

Also it is unlikely that US Supreme Court will ever hear arguments in case I am certain that you are in reference to. A three judge panel of of the 9th circuit is rarely able to render such a controversial decision in any case. Judge Rheinhardt likes to get his name in the papers and seems to crave the fawning adoration of the far left in this country. As with his controversial decision regarding the Pledge of Allegiance, this case will likely be reheard by the 9th Circuit en banc, at which time (just the like the Pledge case) another of Rheinhardt's opinions will be relegated to the dust heap of history.
