Marathon IS opensource, as Aleph One. The whole idea behind M:R is that it's not tied to an older engine's file formats, namely Marathon's. Marathon's engine was top notch in its day, but that was 10 years ago. The file formats, particularly map files, simply lack the basic support for modern graphics. They also don't lend themselves toward modern physics engines.
